Direct-to-Consumer Funding
Direct-to-consumer funding is a pre-settlement funding origination channel in which the funding company markets and sells its product directly to injured claimants — through advertising, search marketing, or referral websites — rather than relying primarily on relationships with plaintiffs' attorneys to generate applications. In this channel, the claimant typically applies before, or independent of, significant attorney involvement in the funding process itself, and the funder's outreach to confirm representation and obtain case documents happens only after the application is submitted, which can slow underwriting relative to a referral that arrives already accompanied by attorney cooperation. Direct-to-consumer marketing has drawn more regulatory and consumer-advocate scrutiny than attorney-directed channels, in part because claimants responding to advertising may be under greater financial distress and less positioned to evaluate competing offers or fee structures carefully, and in part because the marketing itself sometimes implies faster or larger funding than a given case will actually support once underwritten. Because attorney cooperation is still required to complete any transaction — the acknowledgment agreement cannot be skipped regardless of how the application originated — direct-to-consumer funding does not eliminate the attorney's role, but it does shift the point at which the attorney becomes involved from origination to verification.
Funders running direct-to-consumer acquisition typically see lower approval and disbursement rates per application than attorney-directed channels, because a meaningful share of direct applicants either lack representation, are pursuing cases too weak or too early to fund, or come from law firms that decline to cooperate with an application the firm did not originate.
The scrutiny this channel draws also means funders relying heavily on it face more direct exposure to marketing-related regulatory claims — misleading advertising of terms or approval speed — than funders whose volume comes primarily through attorney referral relationships.
