Reasonable Value Challenge (Medical Lien Billing)

A reasonable value challenge is a defense argument, raised in litigation or settlement negotiation, that the amount billed by a treating provider under a letter of protection overstates the reasonable value of the medical services actually rendered, typically by comparing the billed rate to what the same provider accepts from insurers, Medicare, or Medicaid for identical procedures. Because LOP providers are not constrained by a negotiated insurance rate at the time of billing, the gap between billed and typically-accepted amounts can be substantial, and defendants use this gap to argue that the plaintiff's claimed medical specials — and therefore the anchor for pain and suffering multipliers commonly used in settlement valuation — are inflated. How courts treat this argument varies significantly by jurisdiction: some apply a collateral source rule that limits evidence of billed-versus-paid discrepancies at trial, some allow discovery into the financial relationships between the provider, any medical lien funder, and referring counsel, and others have adopted rules specifically addressing what a jury may consider when a plaintiff was treated on a lien basis rather than through insurance. Because the outcome of a reasonable value challenge can materially reduce the medical specials underlying a settlement demand, it directly affects both the claimant's net recovery and the ability of any lienholder — provider or medical lien financing company — to be paid in full from proceeds.
