Can I Apply for Pre-Settlement Funding While Receiving Workers' Compensation?

Yes — receiving workers' compensation benefits does not automatically disqualify you. Qualifying cases include those with a third-party liability claim separate from the WC claim.

Workers' compensation benefits and pre-settlement funding operate on separate tracks. If you were injured at work and are receiving WC benefits, you may still qualify for pre-settlement funding if you have a qualifying third-party claim — a lawsuit against a party other than your employer whose negligence caused or contributed to your injury. Common examples include defective equipment manufacturers, contractors on your job site, or at-fault drivers in a vehicle accident during the course of employment.

The pre-settlement funding is secured against the third-party lawsuit, not the WC claim. Workers' compensation benefits are a statutory entitlement paid by your employer's insurer regardless of fault — they are not a "case" that can be funded in the traditional pre-settlement funding sense. The third-party tort claim, however, can qualify if liability is established and the projected recovery is sufficient.

One important consideration: a portion of your workers' compensation benefits may be subject to a lien in favor of the WC insurer when your third-party case settles. Your attorney will handle this at closing. The existence of a WC lien reduces your net recovery, which in turn affects how much pre-settlement funding you can qualify for. Your attorney should factor this into any advance discussions.

If your only claim is the WC claim itself (with no third-party negligence component), pre-settlement funding is generally not available — WC benefits are administrative, not litigation-based, and the structured WC system does not produce a tort settlement that can secure a non-recourse advance.
