How Long Does It Take for a Settlement Check to Clear in the Bank?

A settlement check deposited to an attorney trust account clears on the same timeline as any other check through the banking system, but with a few nuances that affect speed. Wire transfers from large insurers or defense counsel clear immediately or within one business day. Paper checks from institutional issuers (large national insurance companies) typically clear in one to three business days. Checks from smaller or regional insurers, or from individual defendants, may take longer — up to seven business days under Regulation CC.

Attorneys often apply a conservative hold policy to settlement funds — allowing more time than the strict clearing window requires — specifically to ensure that funds are genuinely available before distributing them. Distributing funds that subsequently bounce creates professional liability exposure and trust account compliance problems that attorneys are highly motivated to avoid.

After the check clears, your attorney still needs time to prepare the settlement statement, confirm all lien amounts, and issue the distribution. This administrative work typically takes three to five additional business days for straightforward cases. Cases with multiple lienholders, Medicaid/Medicare involvement, or probate complications take longer.

Total timeline from settlement agreement to money in your account: for a straightforward personal injury case with a single insurer, good lien documentation, and no court approval requirement, expect two to three weeks from the date the settlement check is issued. Complex cases or those involving federal liens commonly take four to eight weeks.
