The best interest standard is the substantive test a court applies under a state SSPA before approving a structured settlement factoring transaction, requiring the judge to find that the proposed transfer serves the payee's best interest — and, where the payee has minor children or other dependents relying on the payments, that it serves their best interest as well — rather than simply confirming the payee's informed consent.
