Reputable pre-settlement funding companies charge no upfront fees of any kind. There are no application fees, underwriting fees, processing fees, or administrative charges before funding is issued. If a funder asks for money before you receive your advance, do not proceed — this is a major red flag and a common pattern in predatory or fraudulent funding operations.
All costs associated with legitimate pre-settlement funding are built into the funding agreement itself — specifically the rate structure applied to your advance amount, which accrues over the life of your case and is repaid from your settlement proceeds. You pay nothing out of pocket at any point in the process: not when you apply, not when you are approved, and not during the case.
What you may encounter in some funding agreements: an origination fee or administrative fee that is rolled into the advance and repaid at settlement (not charged upfront). This is distinct from a fee charged before funding is issued. If any fee is deducted from your advance rather than charged to you separately, confirm whether it is disclosed in the agreement and whether your attorney has reviewed it.
The ALFA Consumer Litigation Funding Code of Conduct explicitly prohibits member funders from charging upfront fees. When evaluating any funder, ask them directly: "Do you charge any fees before I receive my advance?" A legitimate company will say no — unequivocally.
