Inactive Docket (Deferred/Administrative Docket)

An inactive docket, sometimes called a deferred or administrative docket, is a case management mechanism used in some MDLs to hold claims that have been filed to preserve the claimant's rights against an applicable statute of limitations but that are not yet ripe for active litigation — most commonly because the claimant has been exposed to the product at issue but has not yet been diagnosed with a qualifying injury, or because a diagnosis exists but does not yet meet a minimum severity or type threshold the docket is currently litigating. Placement on an inactive docket removes the claim from active case management deadlines such as fact sheet submission and census requirements while preserving the claim's filing date and its place in the MDL, with the case management order typically specifying the trigger — such as a subsequent diagnosis — that would move the claim onto the active docket for full litigation. Inactive dockets are particularly common in mass torts involving screening-detected conditions or long latency periods, where large numbers of exposed individuals may never develop a compensable injury, and requiring every exposed person to actively litigate immediately would overwhelm the court and the parties with claims that may never mature into a genuine dispute. Some inactive docket orders impose periodic status reporting or reactivation deadlines to prevent claims from remaining indefinitely dormant.

Claims on an inactive docket represent contingent, unrealized exposure rather than currently litigable value, and funders should not treat inactive-docket claim counts the same way as active claim inventory when assessing a firm's near-term recovery pipeline.

Because reactivation depends on a future diagnosis or triggering event that may or may not occur, inactive docket claims are better modeled as a long-dated option on future value than as a near-term asset, and any financing structured against a firm's total claim count should discount the inactive-docket portion accordingly.
