Special Master (Mass Tort)

A special master is a neutral third party appointed by the court under Federal Rule of Civil Procedure 53 to assist with specific tasks in an MDL that exceed the court's own capacity to manage directly, most commonly discovery disputes, settlement allocation and claims administration, and common benefit fee allocation among PSC firms. Special masters are typically retired judges or senior practitioners with subject-matter or MDL-specific experience, and their fees are usually paid from a court-ordered assessment on the parties or from the common benefit fund rather than by the court itself.
