Case Status Monitoring
Case status monitoring is the ongoing process by which a pre-settlement funder tracks the progress of a funded claim between the initial advance and final resolution, typically through periodic check-ins with the claimant's attorney rather than direct contact with the claimant. Funding agreements generally include a covenant requiring the attorney or claimant to notify the funder of material developments — a settlement offer, a mediation date, a change of counsel, or the filing of suit — because the funder's return depends entirely on outcomes it cannot observe independently and has no right to influence. Monitoring serves two purposes: it lets the funder update its case value assessment as new information arrives (a helpful development can support a follow-on advance; an adverse one may trigger portfolio-level reserve adjustments), and it protects against the specific risk that a case settles without the funder's knowledge and disbursement occurs without the assignment being honored. Because funders have no visibility into settlement negotiations unless counsel provides it, monitoring in practice depends heavily on the strength of the funder's relationship with the law firm, and firms that reliably provide updates tend to receive faster decisions and better terms on future referrals from the same funder.
A funder's exposure to undisclosed settlements — where a case resolves and proceeds are distributed without the funder being paid from the assignment — is a real operational risk, which is why monitoring covenants and attorney acknowledgments exist as a backstop rather than a courtesy.
Funders also use status updates to decide whether a case has moved far enough along to support a second advance without exceeding a safe proportion of the now better-understood settlement range, turning routine monitoring into the primary trigger for buyout and re-funding decisions.
