Is pre-settlement funding a loan?

No. It is non-recourse and repaid only from the recovery. If the case does not produce a recovery, nothing is owed.

What does it cost?

Rates and terms are set by the capital provider and written in the provider's agreement before signing. Where a state sets a lower limit, the state limit applies. The capital provider sets the rate from the case record and writes it in the agreement before signing.

Who makes the decision?

The capital partner decides. Timing depends on the case, on how quickly counsel provides documents and on the provider. We tell you what we need and what comes next.

Do I need an attorney?

Yes. Funding is generally considered for plaintiffs who have retained an attorney, and we work through your attorney.
