A litigation funder provides capital against the value of a legal claim or a group of claims. Repayment depends on the outcome of the case. Funders serve injured plaintiffs who need an advance before settlement, law firms that need working capital, and businesses that want to pursue a commercial dispute without paying for it from operating cash.

Funders differ in structure. A non-recourse advance is repaid only if the case produces a recovery. Other products are recourse, or are secured by a law firm's receivables. Pricing may be a monthly rate, a flat fee, or a share of the recovery, and the rules that apply to each vary by country and, in the United States, by state.

When you compare funders, ask for the same facts from each one: whether the advance is non-recourse, how the cost is calculated and how it compounds, what fees are charged at closing, how long a decision takes, which jurisdictions and case types the funder serves, and the minimum and maximum amounts. Get the terms in writing before you sign.
